To what extend house owner can interfere in our privacy and personal matters?

On December 15, we shifted to a new 2 Bedroom home with 40,000 advance and 7,000 per month rent. Rent agreement was made for 11 months. I want to know legal solution to my problem.







New house owner and his wife are the real headache. They visit our residence continuously and in the past 5 months they might have visited us at least 50 times. Except 2 times, they come in the absence of my husband. That's not the problem. They treat as we are homeless and without my permission, they enter home whenever they feel. They enter even our bedroom and bathroom too and scolds me for one reason or other mercilessly finding reasons, sometimes they come single and sometimes together. Main complaints are about neatness and arrangement of things and they behave as if I am their servant whose duty is to strictly obey their orders and arrange our things the way they desire. I clean home daily and a servant comes twice a week who cleans home and premises. Yet, it's not meeting their expectations and they become violent even if a bit of paper is found in courtyard. My only job is to open the front door and if the door is already open, they never ask my permission too. Now whenever they arrive my blood pressure increases and I am not able to concentrate in anything. In most cases, when they shout aloud, neighbours gather around though they remain quiet. They might have scolded me at least 25 times and very often, it extends up to 1 hour or so. They have even asked my 5 year old daughter not to play with toys, paper or colors inside their home.







Now let me describe in brief. Last week, on my request my hubby phoned them and told to come home only when he is present. Yet, 2 days before they came at around 11am and in anger, I closed the doors before them. It was the end of my patience for the past 5 months of tolerance. They even tried to open the door.







Anyhow we have decided to shift to a new home as soon as we get a new dwelling place. They have never given me peace in the past 5 months and mentally, I am disturbed. I just want to know, what are the rights of a house owner, if nothing is specified in rent agreement. What's the extend of their rights? Also, legally how can I proceed if they cause disturbance here after too?

As a tenant, you are in lawful possession of the house and nobody- even the house owner- can cause any disturbance to you. They have no business to monitor day to day maintenance or cleanliness of the house. If they enter without your permission, they are trespassers and you can lodge criminal case against them in various sections of Indian Penal Code.

Encroaching in to your territory itself is an offence. Even the police personnel cannot enter your premises without your permission. In any way you look, you have an upper hand in this matter. I advise you to exercise your tenant rights and teach the owner a lesson.

Your land lord have not any right to enter in your home without your permission. Stop them.

I feel that you need to have a talk with them nad tell them that as tenants you too have rights and they cannot make a nuisance of themselves.In fact , even the owner should ring and take prior permission before visiting tenant, thats what I do with my tenant.There is no question of barging into a home, even if it is your own , while it is being occupied by someone else ,leave alone check all the rooms ... The best thing is to leave the place since the owners seem to be uncouth and may not change !

You have an agreement and they are no to interfere till 11 months as you paid the money what they asked you to pay just show them the agreement and ask them to stay away.... they cant do anything

They have absolutely no right to treat you in this manner. You are their legal tenants and not servants. They also cannot enter your home any time they wish and walk all over the place, even if the house is theirs, you pay rent for occupying their house and hence, they can only oversee and ensure that you are not damaging their property as such. Other than that they have no right to comment and in general harass you in such a horrible manner. You can take legal action but why involve yourself with such people and invite headache and loss of sleep. It would be better if you just shift to a new house with more congenial owners. These kind of people will always find some means of harassing you even if you are somehow able to stop them entering your home.

I think you are the owner of the house as long as the agreement runs. And even if the real owner wants, he cannot encroach on your privacy. Go on with legal matters if you really need to fight that out.

This is common problem with the tennants. I remember when we used to live in Gurgaon on rent we were three friend who used to live on the first floor and the house owner who used to live on ground floor always has a complaint regarding cleanliness we were so much disturbed with his attitude that we left that house in just 5 months. I would prefer a separate house on rent.

Sandhya Rani It's separate home Sanjeev. Now it seems my last response has really worked. Though they come here, they never enter home or talk at me. Just go to their coconut trees behind the home and go back. Only problem is that, we are still in search of a good home and we are not getting it. I am leaving in a place where uncultured people lives. I have faced many problems which I cannot discuss here openly. My condition was even worst. I would say don't open the door. If they shout, you should also shout and insult them at the top of your voice. Otherwise you will feel embarrassed to stay there. Try to find out a better place and get yourself shifted.

Today almost all house owner interface in renter matter. They ask to less use of water and electricity and restrict us to certain portion of house. This need to be removed.

Well, you need to talk and explain them why it is not an healthy habit to just walk into your rented house even if they are the owners. Most owners do visit but only a couple of times to check if you have settled or not and if anything else is required in order to make your stay comfortable. Frequent visits happen only when you let your house owner know that you wish to vacate their house..so to show their house to prospective tenants they may visit but with your permission..and to check whether the house is in the same condition when it was rented it out to you.

As per your description, it is nothing less than trespassing.
