The entire episode of negligence of the Article 370 was due to the callousness of the past governments. All along they have been seeing the fun leading to gigantic proportion. In any way you look at it, it is high time to scrap article 370.

 

@ Mohan manohar. Surprised at your view. Go to Goa and see how single marriage and no triple Talaq is accepted by Muslims. No Sharia in Goa, the Portuguese enforced uniform civil code. There is no problem if uniform civil code is enforced in India. By the way uniform civil code does not mean imposition of Hindu law.

That is the whole point, any measure taken to strengthen the constitution and make the nation stronger and progressive is always met with such blocks by everybody.They don't seem to think that uniform law and religious freedom are two different issues and should not be mixed and religion can never come in the way when it is a matter of national interest

True. Uniform law and religious freedom are different issues. But that is how the opposition political parties spread the confusion among the people for their own political benefits. Especially those who allowed the constitution and the country allowed to rot all these years.

 

I know most of these repurcussions of not implementing uniform civil code rests on ladies of said minorities, but it is obvious that it is difficult to implement as once in past Rajeev Gandhi tried it and failed, and most of these fundamental law of principles are best option for democracy but sadly as per multi linguistic and religion country such as India, it is difficult to implement.

As I wrote earlier, personal law relating to community internal issues like marriage, divorce is not capable of being nade uniform for all.  Any such attempt only strenghtens the belief that the Hindutva is being forced on all sections of society.  There may be need for reforms in minority peresonal law but initiiative must be from the concerned community. It will not be out of place to mention that the dreaded Sati system was abolished only at inititiative of Hindu community leaders like Raja ram Mohan Roy.

Are you aware that Hindus opposed abolition of Sati and equating with murder in Bengal tooth and nail. They even went up to the Privy council in England to get sati restored after Lord  Bentick banned. Raja Roy did a good jog, but he could not have done anything if Lord  bentick had not banned it. By your logic then Turkey( despo\ite being Muslim has a secular constitution) < France and the USA and our own state of Goa must accept Sharia as Muslims don't want it. Please read how Kemal Ataturk modernised Turkey. 

I am of the view that these two are monstrosities fundamentally distorting our status as a secular nation and one has be an intellectual fossil to lend support to this anomalous dispensation. Here again, Nehru is the villain of the piece- more specifically in relation to formulation and putting into practice of a common civil code. By allowing this disgraceful dual dispensation, we have made ourselves a laughing stock in the eyes of the entire world. There have been quite a few proddings by no other than the Supreme court of India but who cares? Any person with rudimentary familiarity with legal jurisprudence would turn white in sickness. Existence of any community specific civil code strikes at the very roots of our Fundamental Rights as enshrined in the Constitution.

@ Chinmoy. I'm in total agreement with you. These  monsters were nurtured and groomed by the party that ruled this country for decades. now it's time to kill the monitor and bury for good.
