Judicial Sloth Defeating the Goal of Justice

 

The judiciary is facing one of the worst crises in its history . Dispensation of justice is somewhat mired in ordinate delay and sloth and has reached such a point that the people of this country have started feeling extremely despondent about it. The cycle of filing a case and its eventual disposal takes an inordinately long time and may be more than a life time. The matter has agitated the minds of all the right thinking persons of the country and a topic for discussion before many a forum and conference but the progress in this direction has hardly been evident.

 

The most popular and well-known saying “ Justice is delayed is justice denied” “ hardly bear reiteration here. It is one of the fundamental rights established and accepted in every civilized society. India being no exception our citizens too have a right enshrined in our constitution to get justice. And the agencies entrusted with the task of providing justice viz., various courts of the country have utterly failed to keep pace with demands of the changing times. The delivery system seems to have developed very serious faults. Even judges have started ventilating their sense of frustation in this regard.

 

The population of India has grown enormously and the demand for service too has risen significantly over the last few decades since Iindependence but the judicial infrastructure needed to cater to the needs of such such vast populace has not been developed. Similarly the use of modern tools and technologies which can go a long way in imparting the speed and dynamism into the system has not been thought of . Digitilazation and computerization have produced tremendous results in other fields and there is absolutely no reason why we can not replicate the success in this field too. By the admission of a Supreme Court judge that thaere are some 2.5 cases pending before the Apex court alone and one can fairly appreciate true magnitude of the problem.
