If we are not satisfied with manufacturing date of refrigerator?

Last Sunday, we went to a Reliance shoppe (opened just one month ago) to purchase a new refrigerator - Whirlpool quick chill (neo ichill) model. Two days before, when we visited the shop the item displayed was 33,000 when its actual cost was around 37000. Sunday it was displayed 31,000 and when dealer gave us 1000 rs discount as special, we purchased the item. We asked them to deliver a fresh piece. They delivered the product next day.







But the item was filled with dust when opened the cover and the basement thermocol was filled with black dust or fungal infected. When we checked the manufacturing date, found that it is 14 months old. Its sides are bend too. Why should we purchase such an old product with huge expense when its warranty is just one year from the time of usage?? Seeing this we didn't even operate the system.







So, we contacted customer care, both reliance and whirlpool and after Engineers checked the product, they are not willing to replace the product. They say, stocks will normally reach after 1 year and it's common. Dust is common in sealed packages and that all whirlpool fridges have bend sides. Is it true? As far as my knowledge, if customer is not satisfied with the product dealer should exchange it. What can we do now?

What all you need to do is, without any delay lodge a complaint in the district consumer forum with the photocopies of all the relevant documents, that is warranty, cash receipt etc. A consumer need not pay any lawyer charges..State Clearly the reason for your dissatisfaction and what you demand from the trader.

If the product delivered is not satisfactory one can return it.But it is always better to get it unpacked by the deliverers and see that everything is fine or if there is any damage right in front of them before you sign the delivery receipt.This saves a lot of complications and also you can ask them to take it back and replace it since they will have no other go...however, no one can force a customer to keep a product that doesnt come upto the promised standard...

Sandhya Rani We have won at last. Whirlpool directly delivered the new series of exactly the same product. We didn't have to pay the excess amount too. Surprisingly, its outer cover is made of some strong material of good quality. Thus we got Whirlpool's latest product - ichill in 30K rupees, when its MRP is 37 or 38K. The product delivered was manufactured on February, so new series as shown in Ad.
Thanks to all for your kind reply and special thanks to Boddunan too, only through the ads displayed here I came to know that Whirlpool has renovated the same product, and what given to us belonged to their old series!

As the dealer is reluctant to replace the refrigerator with new one, you need take legal action by taking up the case with Consumer forum stating therein that there is deficiency in service. I hope that a simple notice by your lawyer will suffice.

You have right to return it. It will no difference that it is 14 year old but it damaged one so you can denied to accept it.

First of all, read the warranty card carefully and see if you have a clause for replacement or repair. Even if it has no replacement clause you can have it replaced with little bit of efforts. Just lodging a complaint online with consumer forum and a copy to reliance and your dealer would do the trick. You can see their email addresses in the bills and brochures.

They must change the refrigerator. Ask them to return your money and take the product back. Buy it from authorised dealer a fresh piece.

!!! even we having Whirlpool refrigerator but its sides are not bend! That's should be excuse and poor one. You surely deserved new and fresh piece like you want. And they can't denied it for the same.

The thing is that you should have enquired about its date of manufacture before purchasing the piece, especially when you knew its current price is much higher than that was displayed. That should have made you suspicious. Also since you have not yet operated the refrigerator yet, you do not know whether it functions properly or not. An electrical gadget is not a perishable commodity and normally its manufacturing date does not affect its functioning. The dust etc. is common enough in all such appliances even when they one or two months old and unless it is not functioning, you cannot expect the Reliance or the manufacturer to replace only because it is an old piece. So I would suggest that you read the fine print in your warranty book and then take action accordingly and I am sure going to a consumer forum may not help you because you were not charged with a current market rate for an old piece. But you may speak to a legal adviser about it.

Sandhya Rani But we asked them to give the fresh piece. Also, seeing the recent ads we came to understand that they have renovated the same product. So, it's pretty clear they have given us the old model of same product, a product that company have already stopped production - Sandhya Rani - 11 years ago
Sandhya Rani I came to know it from ads displayed in Boddunan page itself. We asked them the new product seeing the ads, but they cheated us by making us buy the old product by giving 2000 rs discount. New product is only 34K. Also, we believed that they will dispatch the new piece as we have asked. - Sandhya Rani - 11 years ago

You must go to consumer court. You pay full amount. Why you take used refrigerator. When I purchase electronic item I pay full cash after delivery of item.
