According to egal experts, the allegation against Binayak Sen did not justify imprisonment. He could be let off with fine.

He should not be left with a fine!!We should counsel such people and imprision them if the consequence was supposed to be dangerous!

I agree. But the chargesheet was such that he could be let off with fine. It is for police and public prosecutor to propely frame charge sheet and collect proof. The court will always go according to law and in cae of insufficient proof, accused gets benefit of doubt.

Supreme Court has granted bail to Binayak Sen. The sedtion charges are not substantiated. Mere possessing Maoist literature does not make one Maoist just as possessing Gandhi's autobiography will not make one Gandhian. Supreme Court also holds that mere faith in Maoist ideology will not make one guily of sidition. C.P.I. has hailed the bail and demanded that others arrested similarly should be released.

The bail conditions will be decided by lower court. This decision has given rise to larger discussion as to what constitutes sedition.

Chhatisgarh C.M. has rightly objected to inclusion of Binayak Sen in Planning commission panel. He is a convict alleged with serious charges. A government employee if sentenced even for 48 hours is deemed as placed under suspension. Then how can Binayak sen guilty of supporting Maoists be placed on a government panel.
