    According to law, this is not an example of rape. As both partner are ready for such relationship. No one is forcing another partner.

    There can be three scenarios. 1. Both agree, 2. Male agrees but female doesn't, 3. Female agrees but male doesn't. Well, if it's case 1, then it's not rape at all, otherwise in either of 2 or 3 cases, it's rape. However, among all three case 3rd is rare. In premarital sex, if it's case 1st, it's not rape!

    I think it may be termed as rape, with promises, premarital sex between couple and after relationship, broken promises to marry, as in whatever way, the male seems to be doing injustice to lady, by giving false promise to marry and that creates relationship, it can be termed as rape. :whistle: :whistle: :whistle: :whistle:

    Sexual act under the false promise to marry is also rape according to many decisions. The court has just ruled that every such case cannot be rape. In this case, the girl was herself encouraging the boy. Also it is possible that a boy sincerely intends to marry the girl but circumstances change later. However the lesson is that one must not go for extramarital sex just on promise to marry.

    A girl has premarital sex with some one hoping that he would marry her. But if marriage is denied later, is this rape? There is decsion to contrary. If a girl has premarital relation, this is at her own risk.

    The court found that the girl had herself provoked the man to have sex with her. she expected that he would marry her. The court held this is not rape.


    I agree, sex is personal choice in case of an adult, they should know the outcome at a later stage beforehand. If a party fails to oblige other, it should not be like a legal affair but a social issue. It should be strictly on one to one basis. No one knows why one decided to break a promise. And both were active partner in the act so why one particular one to be blamed?
